A felony DUI is a DUI that is the worst kind. In any criminal case, you have misdemeanors, which essentially are criminal cases that are punishable by County Jail up to a year and maybe a fine up to $1,000, probably a lot less when it comes to the DUI, but when you get into a felony DUI, you’re looking at potentially state prison. With a felony DUI, that just means that there’s something about the DUI that has aggravated it to the point that it’s a felony. For instance, you have three prior DUI convictions that would make the new DUI a felony or that you got into an auto accident and you caused someone to be seriously injured or perhaps killed. Also, if you had a prior felony DUI in the past, this new DUI is going to be a felony regardless of what the DUI is.
